The Setup Loyalty Program Terms and Conditions
The Setup Loyalty Program can be applied to The Setup on Manners. Completing an application for membership in The Setup Loyalty Program and/ or receipt and use of a Loyalty Card (‘Card’) is deemed acceptance by you of these Terms and Conditions (‘Terms’), as amended by The Setup from time to time.
Applications for Membership may be completed in our reception desk or online at https://www.setupmanners.co.nz (‘Website’). Failure to provide any information designated as ‘mandatory’ will mean you will be ineligible for Membership. All information provided by you must be true and correct. You agree to keep your details up to date at all times by advising any changes through the Website, or by advising a staff member in our reception desk.
Applications may be made by any individual who is resident in New Zealand. Only one Membership is permitted per individual. The Setup reserves the right to accept or reject any application and shall not be required to provide any reason for such acceptance or rejection.
You should present your Card on all purchases of The Setup products and services, even if you are not purchasing qualifying products. This is to enable The Setup to provide you with full benefits from the Loyalty Program.
Whenever you make any purchase from qualifying categories from The Setup, you will collect points (‘Points’) based on the amount spent. The amount of spend required per Point and the purchases on which Points can be earned may vary from time to time. You should refer to the Website or check with a staff member for an up to date list of qualifying categories.
Points will expire 52 weeks after the date on which they were received if you have not collected sufficient Points to convert into Rewards. Points do not have any value until they are redeemed for Rewards, and cannot be redeemed for cash.
Claiming a reward
Points will be accumulated and stored on your Card. A Member, who has sufficient points in his or her points record, may request a reward from the then current collection of rewards made available by The Setup. Requests must be made by the member personally. The number of points required to claim a reward is subject to change without notice. All rewards are subject to availability. Rewards will, at The Setup’s option, be posted or delivered to the current address of the member shown in The Setup’s records or made available for collection at a location notified to the member.
The Setup may suspend a member’s ability to claim a reward, without notice and for such period of time as The Setup considers appropriate, if The Setup considers on reasonable grounds that points may have been collected by that Member as a result of fraud by that.
Deduction of points
The number of points published by The Setup for the redemption of a reward claimed will be deducted from the points balance of the member’s points record, with the oldest points being deducted first. The Setup may also deduct from the points balance in a Member’s points record:
Any points recorded in error (including where points have been recorded as a result of a Member being involved in fraudulent activities or where points have been recorded in a Member’s points record but there has been no corresponding purchase of qualifying goods and/or services); and
Any points relating to a transaction that is cancelled or where a refund is given; and
Any points which are not used by a member to claim a reward within 36 months after the end of the month in which the points were recorded. These will expire and be deducted from the points balance in a member’s points record.
If you apply for a Card online, or the first time you access your account online, you will be required to create a secure password to access your account via the Website. You agree not to disclose your password to any other person.
In the event that your Card is lost, stolen or damaged, you will need to request a new Card either in our reception desk or on the Website. An extra $5 will be charged for the replacement of your card. You must advise The Setup as soon as you are aware your Card is lost, stolen or damaged. The Setup does not accept any responsibility for lost, stolen or damaged cards or any resulting loss or theft of Points.
You can collect Points whether you have your Card with you or not. However you must identify yourself as a member before the transaction is completed. Members can only redeem Rewards by presenting their Card at the time of payment. Your Card may only be used for transactions made by you personally. The Setup reserves the right to require identification when collecting Points, redeeming Rewards, or otherwise using your Card.
These Terms, including (without limitation) how Points may be accumulated and/or redeemed and on which products and/or product categories, may be amended by The Setup at any time without notice to you. Without limiting the foregoing, The Setup may add or remove products and/or product categories eligible for the collection of Point, offer bonus Points or alter the level of spend required to accumulate Points, whether temporarily or permanently, at its sole discretion. Current Terms can be viewed on the Website, so it is recommended that you check these periodically. Continuing to use your Card after changes to the Terms are made is deemed acceptance of those changes.
From time to time The Setup may provide Members with additional offers or promotions in connection with the Card (‘Promotions’). These Terms shall apply to such Promotions in addition to any specific terms accompanying such Promotions. In the event of any inconsistency, the specific terms of the Promotion shall apply.
The Loyalty Program may be terminated at any time without notice to you. In the event the Loyalty Program is terminated, The Setup reserves the right to cancel all Points accrued by you.
Except for any liability that cannot be excluded by law, The Setup (including its officers, employees and agents) excludes all liability (including negligence) for loss or damage; whether direct, indirect, special or consequential, arising in any way out of the Loyalty Program or any Membership, including but not limited to, where arising out of: (a) any technical difficulties, network failures, virus or equipment malfunction (whether or not under Farmers’ control); (b) any loss, theft, unauthorized access or third party interference with or of Points, Rewards, or the Card; (c) any Points or Rewards that are not properly recorded against a member’s Card; (d) participation in, or termination of, the Loyalty Program.
